ViralVote

Terms of Service

Last updated:

ViralVote publishes this page in English and Hebrew. If the two differ, the version better for you applies.

1. Who we are and what this is

ViralVote (the "app") is a game made and run by Ravid Rinek, an individual in Israel ("we", "us"). These Terms of Service are the agreement between you and us about using the app. By tapping CONTINUE when you first open the app, you agree to them. If you don't agree, please don't use the app.

Two other pages go with these terms:

  • the Privacy Policy, which explains what we collect and why, and how to delete your account;
  • the Community Standards, which explain what you can't do in the game and what happens if you do. They are part of these terms.

2. Who can play

You must be at least 13. If you're under 13, you can't use ViralVote, and we'll close any account we find that belongs to someone under 13.

If you're under 18, please read these terms with a parent or guardian.

3. Your account

We create an account for you the first time you open the app, so you can play straight away without signing up. It has no email or phone number attached. We also give you a recovery code: save it, because it's the only way to get your account back on a new phone. Keep it private; anyone with it can restore your account.

  • One account per person. Don't share, sell, buy or transfer accounts.
  • You're responsible for what happens on your account.
  • You can delete your account at any time: in the app (Profile → Support & Legal → Delete account) or on the web. Deleting is permanent.
  • We may pause or close an account that breaks these terms or the Community Standards. When we do, we'll tell you why and how to ask us to look again, unless the law stops us.

4. Your player name, and the name of a league you make

You write two things in ViralVote and nothing else: your player name and, if you make a friends league, that league's name. Your avatar is built from pieces we provide. There's no chat, no messages, no comments and no text on invites or requests.

Your player name is shown to the players you race and on the league tables you're in. A league's name is shown to its members.

A name can't:

  • contain slurs, hate, or sexual, violent or self-harm content;
  • pretend to be another person, a celebrity, or anyone from ViralVote;
  • contain contact details: an email, phone number, address, link or a handle for another app;
  • use someone else's brand or trademark.

We check every name automatically before it's saved, and a league name again every time it's changed. We may reject or change a name at any time. Trying again and again to get a banned name through can get your account paused.

The name you choose is yours. You let us show it in the game for as long as your account exists, and in the record of past races for as long as we keep that record.

5. Friends leagues

You can make a friends league and invite people with a code. A friends league is private: it can't be browsed or searched, and nobody joins without a code and a yes from you (or a helper you pick).

  • As the owner you can rename the league, say yes or no to people who ask to join, remove members, pick a helper, hand the league to someone else, or delete it. You can't see anything about members that they don't already show every player.
  • Anyone can leave a friends league at any time, straight away.
  • Points in a friends league count only in that league.
  • We may rename or delete a league whose name or purpose breaks these terms. If we do, we'll tell you why and how to argue with us, and members are told that we changed it, not you.
  • If you delete your account, the league doesn't close. It passes to another member and keeps its name.

6. Play fair

Don't:

  • use bots, scripts, macros, modified apps, emulators or anything else that changes how the game plays;
  • exploit a bug (tell us about it instead);
  • team up with others to fix a race;
  • make more than one account;
  • mess with our servers, or try to get into someone else's account or data;
  • scrape, copy or republish the questions, pictures or other content in the app;
  • reverse-engineer or decompile the app, except where the law allows it anyway.

Breaking these rules can cost you your account and your progress.

7. House players

Some racers are house players: computer-run racers we operate, not people. They fill races so a race can start straight away, and they fill official league groups, which hold up to 50 racers. They race and score by the same rules as you, have a name, a picture and points, and can finish in any place, including first. Your reward follows your place on the board, house players included.

A house player never sends you anything, never joins a friends league, and its name and picture are made up and never belong to a real person.

8. Questions, opinions and the crowd pick

We write the questions in ViralVote. Some are deliberately cheeky, and some ask for your opinion rather than a fact.

Opinion questions have no true answer; in a race they're scored against the crowd pick. The crowd pick is a weighted count of real players' votes, not a head count: a vote counts more the older and more active the account and the more recent the vote, counts for almost nothing if it was speed-tapped (judged only from tap timing, never from the answer picked), and never counts if a house player cast it. Until a question has enough real votes, it's scored against our own forecast, shown as OUR PICK. Any percentages shown after an opinion question are those weighted shares, or our forecast.

Bonus Rounds. Sometimes a league opens a Bonus Round of opinion questions. Finishing it earns a fixed reward, the same for everyone, unless the round was speed-tapped, in which case it earns nothing. That's the only consequence: nothing you have is taken away and your points and place don't change.

Questions may name and show real public figures, for fun, comment and identification. None of them endorses or is connected with ViralVote.

9. Coins, power-ups and other items

Coins are ViralVote's in-game currency. You earn them by playing and spend them on power-ups and other items in the game. Nothing in ViralVote costs money, and you can't buy coins. If we ever sell anything, the payment will go through Apple or Google, and we'll update these terms before we do.

  • Coins, power-ups and items have no money value. They can't be exchanged for money or anything outside the game, and can't be traded, gifted or moved between accounts.
  • There are no prizes in ViralVote. Coins and items aren't prizes.
  • Coins don't expire. We may change what's on offer and what it costs in coins, but we won't take away coins you already have, except where you broke these terms.
  • Nothing you can get with coins has random contents.
  • If your account is deleted, its coins and items are gone.

10. Reporting and blocking

  • Report a player from their name in the game. To report a league name, or anything else, email support@viralvoteapp.com.
  • Block a player and you won't be matched with them or see their name. They aren't told.
  • Reporting someone to harass them, or mass-reporting, breaks these rules too.

Something illegal? Anyone, with or without the app, can tell us about content in ViralVote they think is illegal. Our report page explains what to send, what we do with it and how to challenge our decision.

11. Our content, and your licence to use the app

The app, the game and its content belong to us or to the people who licensed them to us. We give you a personal, non-exclusive, non-transferable licence to install and use the app on devices you own or control, under the rules of the store you got it from. It's a licence, not a sale, and it ends if you break these terms.

Many photos in the game are used under Creative Commons licences. Where such a licence gives you rights in an image, nothing in these terms takes them away.

If you think something in ViralVote infringes your rights (for example, a photo of yours), email support@viralvoteapp.com with enough detail for us to find it. See the report page for what to include.

12. Changes

ViralVote is a live game. We change it often, and we may pause or end any part of it, or the whole game. If we ever end the game, we'll give you notice in the app first.

If we change these terms in a way that matters, we'll tell you in the app and ask you to accept the new version before you carry on. The date at the top shows when they last changed.

13. The app comes as it is

We make ViralVote with care, but it's a free game, provided as it is and as available. We can't promise it will always work, be error-free, or keep every feature, score or item forever.

14. Our responsibility to you

Nothing in these terms limits:

  • rights you have under the consumer law of the country you live in that can't be given up by agreement;
  • our responsibility for harm we cause on purpose or through gross negligence;
  • anything else the law doesn't let us limit.

Apart from that, and as far as the law allows, we aren't responsible for losses that weren't reasonably foreseeable, or for losing in-game progress or items, which have no money value.

15. If you got the app from the App Store

  • These terms are between you and Ravid Rinek, not Apple. We, not Apple, are responsible for the app and its content.
  • Apple has no duty to provide any support or maintenance for the app.
  • If the app fails to meet a warranty that applies to it, you can tell Apple, and Apple will refund the price you paid (the app is free). Apple has no other warranty duty for the app, as far as the law allows.
  • We, not Apple, handle any claims about the app, including product liability, failing to meet a legal or regulatory requirement, consumer protection, and claims that the app infringes someone's intellectual property.
  • You confirm that you're not in a country under a US government embargo or named by the US government as supporting terrorism, and that you're not on a US government list of prohibited or restricted parties.
  • You must follow any third-party terms that apply when you use the app.
  • Apple and its subsidiaries are third-party beneficiaries of these terms and can enforce them against you.
  • Apple's standard Licensed Application End User License Agreement also applies to the app. Where it and these terms differ about the app itself, Apple's agreement wins.

16. Law and disputes

If something goes wrong, please email us first at support@viralvoteapp.com. Most problems can be fixed quickly.

These terms are governed by the law of Israel, and the courts of Tel Aviv-Jaffa can hear any dispute about them. If you live in a country whose law gives you the right to rely on your local consumer law, or to go to your local courts, you keep that right.

17. The rest

These terms, with the Privacy Policy and the Community Standards, are the whole agreement between you and us about the app. If a court finds part of them can't be enforced, the rest still applies. If we don't enforce a rule straight away, we can still enforce it later. You can't transfer these terms to someone else. We may transfer them to a company that takes over ViralVote, and we'll tell you if we do.
